Legal Separation is similar to Divorce except that a Decree of Legal Separation does not end the marriage. A Legal Separation is when parties agree to live separately by court order. While the parties are still technically married, there is a court order outlining Child Custody, Division of Property, and Alimony. Generally property acquired while the parties are legally separated is considered the separate property of the person who acquired it. Six months after you have obtained your Decree of Legal Separation you may convert it to a divorce.
